Agreeing to these terms
Cortex Labs is the name under which Rafael Augusto, an independent developer, publishes software. "We" and "us" mean Cortex Labs. "The apps" means Ted Agent, Orbit, Marshall MQ, Lily DB, Barney Kube and Cortex Shelf, Cortex, and any other software we publish, together with their updates and documentation.
Yummo Restaurant OS is a separate web service operated by Yummo Tecnologia da Informacao LTDA. Its own terms govern that service, rather than the desktop-app license below.
By downloading, installing or using an app, or by using the website at getcortexlabs.com, you agree to these terms. If you use an app on behalf of a company, you agree on its behalf and confirm you are allowed to. If you do not agree, do not use the apps.
What you may do
Ted Agent, Orbit, Marshall MQ, Lily DB, Barney Kube and Cortex Shelf are proprietary software, distributed free of charge as compiled applications. As long as you follow these terms, we grant you a personal, non-exclusive, non-transferable, revocable license to:
- download, install and use official builds of the apps, for personal or commercial purposes, on any number of machines you control; and
- share unmodified links to the official download pages.
Cortex is open source. It is licensed under the MIT License included with its source code, and where that license and these terms differ, the MIT License governs your use of Cortex.
The apps include open-source components from other authors. Those components remain under their own licenses, and nothing here limits the rights those licenses give you.
What you may not do
Without our prior written permission, you may not:
- redistribute, sell, rent, sublicense or bundle the apps, or host the installers yourself;
- modify, decompile, disassemble or reverse-engineer the apps, except to the extent the law does not allow this restriction;
- remove or alter copyright notices, or bypass a technical limit or access restriction in an app, including access to a private beta;
- use the apps to break the law, or to access systems or data you are not authorized to access; or
- use our names or logos in a way that suggests we endorse or are affiliated with you.
Your systems and your data
The apps are professional tools that act directly on real systems: databases, Kubernetes clusters, message brokers, messaging accounts, the servers you install Orbit on, and your own Mac. Some of what they can do is destructive or cannot be undone, including writing to or deleting from a database, changing a schema, deleting, scaling or draining cluster resources, consuming messages from a queue, sending messages in your name, controlling other applications, and — on a server running Orbit — replacing a running application, deleting an application or a database, and restoring a backup over current data.
You are responsible for:
- having authorization to access every system and account you connect an app to;
- every action you take or approve in an app, and its consequences;
- keeping backups and testing against non-production systems where the stakes call for it; and
- complying with the laws and the policies of your organization that apply to the data you handle, including other people's personal data.
The apps include safeguards such as confirmations, previews and masked secrets. They are there to help, and they are not a guarantee. A preview or estimate may differ from what a system actually does.
AI features
Some apps offer optional AI features that work through an AI tool installed and signed in on your machine. You need your own account with that provider, and your use of it is governed by the provider's terms and billing, not ours.
AI output can be wrong, incomplete or out of date, even when it sounds certain. Treat explanations, generated queries, schema changes, index suggestions and automated actions as suggestions. Review them before you run or rely on them. You decide what content is appropriate to send to an AI provider.
Third-party services
The apps can connect to services we do not operate, such as WhatsApp, Telegram, Slack, email providers, GitHub, cloud platforms and AI providers. We are not affiliated with or endorsed by them, and their names belong to their owners.
Your use of those services is subject to their terms, and it is your responsibility to follow them. Some services restrict automated or unofficial access to an account, and may limit or suspend accounts that use it. Those services can also change or stop working with an app at any time, and we cannot promise that a given integration will keep working.
Early and beta software
Most of the apps are early releases, with version numbers below 1.0. Features may change or be removed, data formats may change between versions, and there will be bugs. Do not rely on an early release as your only safeguard for anything important.
Access to a private beta is by invitation, is personal to you and may be withdrawn at any time.
Updates and availability
The macOS apps check for and install updates automatically, and Orbit offers its own updates in its console, on the server. Updates may add, change or remove features, and these terms apply to them. We may change, suspend or stop offering any app or the website at any time, without owing you anything for it. We have no obligation to provide support, maintenance or any particular update.
Price and donations
The apps are currently free. If that changes for an app, the copy you already have keeps working under the terms it came with, and any paid offer will be presented clearly before you are charged.
Donations, for example through GitHub Sponsors, are voluntary. They do not buy a license, a support contract or any additional rights, and they are processed by the donation platform under its own terms.
Feedback
If you send us ideas, bug reports or other feedback, you allow us to use them without restriction and without owing you compensation. You are never obliged to send any.
Ownership
The apps are licensed, not sold. We and our licensors keep all rights in the apps, the website, and their names, logos and designs that are not expressly granted to you here. Everything you create, open or store with the apps remains yours; we claim no rights in it, and we never receive it, as our Privacy Policy explains.
No warranty
THE APPS AND THE WEBSITE ARE PROVIDED "AS IS" AND "AS AVAILABLE", WITHOUT WARRANTY OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING THE WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE APPS WILL BE ERROR-FREE, UNINTERRUPTED OR SECURE, THAT THEY WILL WORK WITH ANY PARTICULAR SYSTEM, OR THAT ANY INFORMATION THEY DISPLAY OR GENERATE IS ACCURATE.
Limitation of liability
TO THE FULLEST EXTENT PERMITTED BY LAW, WE ARE NOT LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL OR PUNITIVE DAMAGES, OR FOR ANY LOSS OF DATA, PROFITS, REVENUE OR BUSINESS, ARISING FROM YOUR USE OF OR INABILITY TO USE THE APPS OR THE WEBSITE. THIS INCLUDES DATA LOSS OR DOWNTIME CAUSED BY OPERATIONS YOU RUN AGAINST YOUR OWN SYSTEMS, AND ACTIONS TAKEN BY THIRD-PARTY SERVICES AGAINST YOUR ACCOUNTS. BECAUSE THE APPS ARE PROVIDED FREE OF CHARGE, OUR TOTAL LIABILITY FOR ALL CLAIMS IS LIMITED TO THE AMOUNT YOU PAID US FOR THE APP, IF ANY.
Some countries do not allow certain warranties to be excluded or liability to be limited, particularly for consumers. Nothing in these terms removes rights you have under law that cannot be waived, and in those cases the exclusions above apply only as far as the law allows.
Termination
You can stop using the apps at any time by deleting them. Your license ends automatically if you break these terms; when it does, you must stop using the apps and delete your copies. The sections on ownership, warranty and liability continue to apply afterwards.
Using the website
You may browse the website and download the apps from it for your own use. Do not disrupt it, probe it for vulnerabilities without permission, or automate requests to it in a way that burdens the service or distorts its download counts. If you find a security issue, please tell us at rafaelaugusto.developer@gmail.com.
General
We may update these terms. When we do, we will change the date at the top of this page, and continuing to use the apps after that date means you accept the new version. If a change is significant, we will call it out in the release notes.
If a part of these terms turns out to be unenforceable, the rest still applies. Not enforcing a term on one occasion does not waive it. These terms, together with the Privacy Policy and any license shipped inside an app, are the whole agreement between you and us about the apps.
